2. Nature of Products

LINKKIT products are modular textile creative systems designed for supervised recreational, educational and creative use.
Products are lightweight textile constructions intended for imaginative assembly and personal customization.
LINKKIT products are not classified or intended as:
   • medical devices,
   • food products,
   • childcare or safety equipment,
   • protective or load-bearing products.
Product images are illustrative and minor variations in color, texture or finish may occur due to manufacturing processes.

3. Product Safety Children

LINKKIT products are recommended for children aged four (4) years and older.
Use by children must take place under appropriate adult supervision at all times.
Products:
   • are not edible,
   • must not be placed in the mouth,
   • may contain detachable components unsuitable for children under three (3) years of age due to choking hazards.
LINKKIT products are creative textile systems and are not intended for unsupervised physical activity or mechanical stress.
Use contrary to safety instructions, warnings or intended purpose may result in product damage and shall not constitute a manufacturing defect, to the extent permitted by applicable law.
WARNING: Small parts. Not suitable for children under 3 years due to choking hazard.
Adult supervision is recommended during use.

4. Prices

All prices are displayed in Euros (€) and include applicable Value Added Tax (VAT) within the European Union where required by law.
Shipping costs, where applicable, are calculated and clearly displayed prior to checkout confirmation.
LINKKIT reserves the right to modify prices at any time; however, confirmed orders shall not be affected by subsequent price changes.

5. Payment Conditions

Payments are processed through secure third-party payment providers, including:
• Stripe (credit and debit cards),
• PayPal,
• Apple Pay and Google Pay where available.
Payment authorization may occur at the time of purchase.
Funds may be captured upon order confirmation or shipment depending on payment method and operational processing.
LINKKIT does not store full payment card information.

6. Order Confirmation and Acceptance

A binding purchase contract is formed once payment has been successfully authorized and the customer receives order confirmation.
LINKKIT reserves the right to refuse or cancel orders in cases including, but not limited to:
   • manifest pricing or typographical errors,
   • suspected fraudulent activity,
   • payment authorization failure,
   • product unavailability or stock discrepancies.
In such cases, any payment received shall be refunded without undue delay.

7. Shipping and Delivery

Orders are dispatched from Spain using professional logistics partners.
Estimated delivery times are:
   • Spain: 3–5 business days
   • European Union: 5–10 business days
Delivery times are indicative only and may vary due to logistical, seasonal or operational circumstances beyond LINKKIT’s reasonable control.
Risk of loss or damage transfers to the customer upon delivery of the goods.

8. United Kingdom - Import Responsibility

Orders shipped to the United Kingdom are treated as exports from the European Union.
All import duties, customs clearance fees, import VAT and any additional charges imposed by UK authorities are the sole responsibility of the customer.
Such charges are not included in product or shipping prices.
LINKKIT shall not be liable for delivery delays, additional costs, refused deliveries or shipment returns resulting from customs procedures or failure by the recipient to comply with import requirements.

9. Right of Withdrawal

In accordance with applicable European consumer protection legislation, consumers have the right to withdraw from their purchase within fourteen (14) calendar days from the day on which the customer, or a third party designated by the customer, receives the ordered products.
To exercise the right of withdrawal, the customer must notify LINKKIT of their decision by sending a clear written statement to info@linkkitdesign.com before the withdrawal period expires.

Conditions for Return
Returned products must be sent back without undue delay and no later than fourteen (14) days from the date on which withdrawal was communicated.
Products must be returned:
   • unused,
   • complete,
   • in their original condition,
   • and preferably in original packaging suitable for transport.
Customers are responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.

Return Shipping Costs
Unless the product is defective or incorrectly supplied, the direct cost of returning the goods shall be borne by the customer.

Refunds
Upon valid withdrawal, LINKKIT shall reimburse all payments received from the customer, excluding any additional delivery costs arising from the customer selecting a delivery method other than the standard shipping option offered.
Refunds will be issued using the original payment method within fourteen (14) days after receipt and inspection of the returned goods or proof of return shipment.
LINKKIT reserves the right to withhold reimbursement until the returned products have been received or sufficient evidence of return has been provided.

Exclusions
The right of withdrawal does not apply where products show signs of use, damage, alteration, washing or handling exceeding what is reasonably necessary to assess the product.

10. Legal Warranty and Proper Use of the Product

All LINKKIT products benefit from the statutory two-year legal guarantee established under applicable European consumer protection legislation, covering manufacturing defects or lack of conformity existing at the time of delivery.
LINKKIT products are modular textile systems designed for creative, recreational and supervised use according to their intended purpose.
Due to the innovative construction of the system – including textile interlocking mechanisms without permanent stitching or structural seams – product durability depends directly on appropriate handling, assembly and use by the user.
The legal warranty applies exclusively to manufacturing defects and does not cover damage, deterioration or breakage resulting from, including but not limited to:
   • improper or unintended use of the product,
   • excessive mechanical stress, pulling, tension or weight loads beyond normal creative use,
   • use for purposes different from those for which the product was designed,
   • aggressive handling, forced separation of connected elements or misuse of modular connections,
   • normal wear and tear resulting from repeated use,
   • accidental damage,
   • alteration, modification or repair carried out by the user or third parties,
   • washing, cleaning or maintenance contrary to provided care instructions,
   • use without required adult supervision when applicable.
LINKKIT products are creative textile constructions and are not designed to withstand structural loads, climbing, suspension, traction forces or other uses involving body weight or
mechanical strain.
Breakage or deterioration resulting from the above circumstances shall not be considered a manufacturing defect or lack of conformity under applicable consumer law.
Nothing in this clause limits statutory consumer rights under mandatory European legislation.

11. Intended Use and Functional Limitations

LINKKIT products are modular textile creative systems designed to encourage creativity, experimentation and personal assembly through textile connection elements.
The products are intended exclusively for recreational, decorative and creative purposes consistent with their nature as lightweight textile constructions.
Due to their modular and open-ended design, users may create multiple configurations.
However, not all possible configurations constitute intended or safe uses of the product.
LINKKIT products are not designed, manufactured or tested for:
   • supporting body weight,
   • climbing, suspension or hanging applications,
   • load-bearing or structural purposes,
   • use as protective equipment,
   • use as furniture or safety devices,
   • mechanical resistance comparable to stitched, reinforced or industrial textile products.
Users are responsible for ensuring that assembled configurations remain appropriate to the intended creative purpose of the product.
Any use involving excessive force, traction, torsion, impact, weight loading or mechanical stress beyond normal creative handling shall be considered use outside the intended scope of the product.
Damage or failure resulting from configurations or uses exceeding these functional limitations shall not be considered a manufacturing defect.
Adult supervision is required when products are used by children.
Nothing in this clause affects mandatory consumer rights established under applicable law.

12. Limitation of Liability

To the fullest extent permitted by applicable law, WHY NOT CREATIVE STUDIO S.L., operating under the LINKKIT brand, shall not be liable for any loss, damage, delay or inconvenience arising from circumstances beyond its reasonable control.
This includes, but is not limited to:
   • delays, loss or damage attributable to logistics operators, postal services or transport carriers,
   • customs inspections, border controls, import procedures or administrative clearance processes,
   • additional import duties, VAT, brokerage fees or customs charges imposed by destination authorities,
   • refusal of delivery or shipment return resulting from unpaid customs or import obligations by the recipient,
   • force majeure events including natural disasters, strikes, transportation disruptions, governmental restrictions, supply chain interruptions or similar unforeseeable events.

Product Use and User Responsibility
LINKKIT products are modular textile creative systems intended exclusively for supervised recreational and creative use.
Due to their open-ended and reconfigurable nature, users may create assemblies or configurations independently. LINKKIT shall not be liable for any damage, injury or loss
resulting from configurations, installations or uses developed by users that exceed the intended purpose or functional limitations of the product.
The company shall not be responsible for damage or product failure resulting from:
   • improper handling or aggressive use,
   • excessive pulling, tension, torsion or mechanical stress,
   • use involving body weight, suspension, climbing or load-bearing applications,
   • unintended or experimental configurations,
   • combination or use together with third-party products or external structures,
   • modification, alteration or repair performed by users or third parties,
   • failure to follow safety instructions, warnings or care guidelines,
   • use without appropriate adult supervision when used by or near children.
   • Parental and Supervisory Responsibility
When LINKKIT products are used by children, responsibility for supervision and safe use rests with the supervising adult.
WHY NOT CREATIVE STUDIO S.L. shall not be liable for incidents arising from lack of supervision, inappropriate environmental conditions, or use inconsistent with provided safety recommendations.

Nature of the Product
LINKKIT products are lightweight textile constructions and are not designed, manufactured or tested as structural, protective, safety or load-bearing equipment.
Normal wear, material fatigue or deterioration resulting from repeated use, environmental exposure or handling shall not be considered product defects.

Indirect Damages
To the extent permitted by law, LINKKIT shall not be liable for indirect, incidental or consequential damages, including loss of use, loss of opportunity, economic loss or thirdparty damages arising from product use or delivery delays.

Mandatory Consumer Rights
Nothing in this clause excludes or limits liability that cannot legally be excluded under applicable consumer protection or product liability legislation, including liability arising from
proven manufacturing defects or personal injury directly attributable to such defects.

13 Product Modification and Combination with Third-Party Elements

LINKKIT products are modular creative systems designed to allow user interaction, customization and reconfiguration.
Users may voluntarily combine LINKKIT components with other objects, materials, furniture, structures or third-party products. Such combinations are created independently by the user and fall outside the control, testing conditions and intended design scope established by WHY NOT CREATIVE STUDIO S.L.
Accordingly, WHY NOT CREATIVE STUDIO S.L. shall not be liable for any damage, malfunction, instability, injury or loss arising from:
   • integration of LINKKIT products with third-party items or structures,
   • attachment to walls, furniture, ceilings or external supports,
   • modified assemblies altering the original configuration of the product,
   • adaptations or transformations performed by users,
   • use together with accessories or elements not supplied or approved by LINKKIT,
   • installations or configurations exceeding normal creative or decorative use.
Any modification, adaptation or combination carried out after purchase is performed under the sole responsibility of the user.
LINKKIT products shall be considered compliant when used independently and according to provided instructions and safety recommendations.
Damage or incidents resulting from modified or combined configurations shall not constitute manufacturing defects or product non-conformity.
Nothing in this clause limits mandatory consumer rights under applicable product safety or consumer protection legislation.

14 Product Traceability and Manufacturer Identification

In accordance with applicable European product safety legislation, including Regulation (EU) 2023/988 on General Product Safety, LINKKIT products are placed on the market by:
